Above Rail and Below Rail
A variation of trackage rights is where the owner of the tracks do not run any trains while all trains are operated by other parties.
Examples include:
- ARTC
- Network Rail
- Amtrak in the United States rarely owns its own tracks, unless it is the only user. AMTRAK has legal priority for its passenger trains over all freight trains sharing those track.
