Fee Simple - Creation and Characteristic of Fee Simple

Creation and Characteristic of Fee Simple

Rules requiring words of general inheritance to create fee simple by conveyance have been abolished by statute in the United States. To convey an estate in fee simple at common law, the deed or will must state "to B and his heirs." Anything short of those words transferred a smaller estate.

Modern deeds usually follow a standardized form. There is a presumption that the testator intends to convey his or her property in fee simple unless the will indicates an intention to transfer a smaller estate, such as a life estate.

Famous quotes containing the words creation and, creation, fee and/or simple:

For me, the principal fact of life is the free mind. For good and evil, man is a free creative spirit. This produces the very queer world we live in, a world in continuous creation and therefore continuous change and insecurity. A perpetually new and lively world, but a dangerous one, full of tragedy and injustice. A world in everlasting conflict between the new idea and the old allegiances, new arts and new inventions against the old establishment.
    Joyce Cary (1888–1957)

There is an incompatibility between literary creation and political activity.
    Mario Vargas Llosa (b. 1936)

I like to be in America!
    OK by me in America!
    Ev’rything free in America
For a small fee in America!
    Stephen Sondheim (b. 1930)

Christina Bailey: I was just thinking how much you can tell about a person from such simple things. Your car, for instance.
Mike Hammer: Now what kind of message does it send you?
Christina: You have only one real, lasting love.
Mike: Now who could that be?
Christina: You. You’re one of those self-indulgent males who thinks about nothing but his clothes, his car, himself. I’ll bet you do push-ups every morning just to keep your belly hard.
