Holding
The U.S. Supreme Court upheld the FCC action in 1978, by a vote of 5 to 4, ruling that the routine was "indecent but not obscene". The Court accepted as compelling the government's interests in 1) shielding children from potentially offensive material, and 2) ensuring that unwanted speech does not enter one's home. The Court stated that the FCC had the authority to prohibit such broadcasts during hours when children were likely to be among the audience, and gave the FCC broad leeway to determine what constituted indecency in different contexts.

Famous quotes containing the word holding:
“But it is the same thing we are all seeing,
Our world. Go after it,
Go get it boy, says the man holding the stick.
Eat, says the hunger, and we plunge blindly in again,
Into the chamber behind the thought.”
—John Ashbery (b. 1927)
“The growing of food and the growing of children are both vital to the familys survival.... Who would dare make the judgment that holding your youngest baby on your lap is less important than weeding a few more yards in the maize field? Yet this is the judgment our society makes constantly. Production of autos, canned soup, advertising copy is important. Houseworkcleaning, feeding, and caringis unimportant.”
—Debbie Taylor (20th century)
“The best part of myself, thats what you are. Do you think Im going to leave it to the vulgar pawing of a second-rate detective who thinks youre a dame? Do you think I could bear the thought of him holding you in his arms, kissing you, loving you?”
—Jay Dratler, U.S. screenwriter, Samuel Hoffenstein (18891947)
