European Patent Convention - Relation With The Patent Cooperation Treaty

Relation With The Patent Cooperation Treaty

A European patent application may result from the filing of an international application under the Patent Cooperation Treaty (PCT) and the entry into "European regional phase". The European patent application is therefore said to be a "Euro-PCT application" and the EPO is said to act as a designated or elected Office. In case of conflict between the provisions of the EPC and those of the PCT, the provisions of the PCT and its Regulations prevail over those of the EPC.

Eleven EPC Contracting States, namely Belgium, Cyprus, France, Greece, Ireland, Italy, Latvia, Malta, Monaco, the Netherlands and Slovenia have "closed their national route". This means that it is no longer possible to obtain a national patent protection through the international (PCT) phase without entering into the regional European phase and obtaining a European patent. Lithuania will also "close its national route" on 4 September 2014.

Famous quotes containing the words relation with the, relation with, relation, patent, cooperation and/or treaty:

There is a constant in the average American imagination and taste, for which the past must be preserved and celebrated in full-scale authentic copy; a philosophy of immortality as duplication. It dominates the relation with the self, with the past, not infrequently with the present, always with History and, even, with the European tradition.
    Umberto Eco (b. 1932)

[Man’s] life consists in a relation with all things: stone, earth, trees, flowers, water, insects, fishes, birds, creatures, sun, rainbow, children, women, other men. But his greatest and final relation is with the sun.
    —D.H. (David Herbert)

To be a good enough parent one must be able to feel secure in one’s parenthood, and one’s relation to one’s child...The security of the parent about being a parent will eventually become the source of the child’s feeling secure about himself.
    Bruno Bettelheim (20th century)

There is a patent office at the seat of government of the universe, whose managers are as much interested in the dispersion of seeds as anybody at Washington can be, and their operations are infinitely more extensive and regular.
    Henry David Thoreau (1817–1862)

There is, I think, no point in the philosophy of progressive education which is sounder than its emphasis upon the importance of the participation of the learner in the formation of the purposes which direct his activities in the learning process, just as there is no defect in traditional education greater than its failure to secure the active cooperation of the pupil in construction of the purposes involved in his studying.
    John Dewey (1859–1952)

It is accordance with our determination to refrain from aggression and build up a sentiment and practice among nations more favorable to peace ... that we have incurred the consent of fourteen important nations to the negotiation of a treaty condemning recourse to war, renouncing it as an instrument of national policy.
    Calvin Coolidge (1872–1933)
